There are several ways to dismiss an employee in Spain but this must be performed with great care as repercussions for the company can be costly if done incorrectly. We will make sure the necessary steps are taken to ensure a smooth execution of the procedure.
End of contract
An employee can be dismissed by allowing their contract to expire. The employer is required to advise the employee that their contract will not be renewed at least 15 days before its expiry.
Dismissal with just cause
A formal warning is issued to the employee in an official letter, clearly explaining how they are violating the conditions set out in their contract. If the employee does not rectify their behaviour, the employer is permitted to dismiss them prior to the end of their contract. A redundancy payment is none-the-less due, and is calculated in relation to the length of time the employee has been working for the company.
Dismissal without cause
An employee can be dismissed without cause with 15 days notice, however the redundancy payment will be substantially bigger than other kinds of dismissals.
