New contracts

All company employees must have a binding employment contract in accordance with the rules and regulations dictated by Spanish law.  To create a contract for a new employee, the employee will have to provide an NIE number (non-residents), DNI (Spanish residents), social security number, address, marital status details and date of birth.  The minimum length of contract is 3 months although a specified trial period can be written in to the contract.

Renewal of contracts

A Spanish employment contract can be renewed up to 3 times within the first two years of employment.  Usually, members of staff are given a 3 or a 6 month contract, followed by a further 6 month contract, followed by a one year contract, but this will depend on the nature of the employment and will be adapted to the specific requirements of your company.  At the end of the two year period, the employee must be issued a permanent contract (indefinido).

Cancellation/ termination of contracts

A company is obliged to pay its employees redundancy money if their employment contract is terminated before it has expired.  If the employee is dismissed on the grounds of wrongdoing, these fees are reduced but not eliminated.  It can therefore often be advisable to allow a contract to expire rather than terminate it.  Our human resources experts offer advice on how best to proceed in these circumstances.
